Terms and conditions

In short

  • A contract exists only after you accept a written quote and pay a 30 % deposit.
  • You may reschedule or cancel at no charge more than 7 days before the session.
  • Consumers who book at a distance have 14 days to withdraw, subject to the statutory exceptions.
  • Once the invoice is paid in full, neighbouring rights in your recording sit with you.
  • The Dutch text is authoritative; this version applies from 1 October 2026.

1. Scope

These terms apply to every booking you make with Claviforge B.V.: Vocal and instrument recording, Mixing, Podcast recording, Mastering and Rehearsal room, as described on the services pages and in the quote. Claviforge B.V. is a private limited company (B.V.) at Danzigerkade 78, 1013 AP Amsterdam, the Netherlands, Chamber of Commerce 85363453, VAT NL879466819B01. Director: Maarten de Vries. Read this before you accept a quote. The contract is formed when you accept a written quote (a signature or an e-mail that clearly agrees) and you have paid the deposit in article 6. Visiting the site or sending the contact form does not bind you.

The documents rank in this order: the special terms in the accepted quote, these conditions and — if you are a business and you send us other people’s personal data — the data processing agreement, which prevails for that data. The privacy policy explains processing; it does not change the contract. If you do not accept these terms, do not accept the quote.

2. Definitions

Words that have a fixed meaning in these terms

DepositThe part of the price you pay when you book, equal to 30 % of the amount including VAT.
RecordingThe sound fixation made during a session, including session files.
Force majeureA failure that cannot be attributed to a party, within the meaning of article 6:75 of the Dutch Civil Code.

3. Information before you book

Before you commit, the site and the quote give you the main features of the service, the price, when we will perform, who we are and the withdrawal rules, as articles 6:230b, 6:230m and 6:230v of the Dutch Civil Code require for consumers. Each service page describes the flow, what is included and the rates: vocal and instrument recording, mixing, podcast recording, mastering and rehearsal room.

We answer questions about a quote within 2 days. How to reach the studio: From Amsterdam Centraal, take metro line 52 (North/South) towards Noord and get off at Noorderpark. Walk about 8 minutes west along Danzigerkade; the studio is at number 78 on the waterfront. By bike from Centraal it is roughly 15 minutes via the IJ Tunnel.

4. Quote and booking

A request by form, telephone or e-mail leads to a written quote. How long it stays open is stated on the quote; we do not hold a slot while it is still free. The time becomes yours only after acceptance and receipt of the deposit. Until then we may give the slot to someone else.

For a distance contract we confirm the booking on a durable medium (e-mail) with the details from the quote. We may refuse a request on a legitimate ground, for example a project that does not fit the rooms, a group larger than 6 in the live room, or the safety rules in article 10.

5. Prices

Amounts on the site and in the quote are in euros, including VAT at the standard rate of 21 % (Dutch Turnover Tax Act 1968). For traders we also show the amount excluding VAT. The price that applies is the one on the accepted quote. An obvious typing error on the site is corrected before you book; that error does not bind us.

Public guide prices on 1 October 2026:

  • Vocal and instrument recording: €95 per hour, €320 for 4 hours, €580 for 8 hours (excl. VAT €78.51, €264.46, €479.34)
  • Mixing: €185 per track, €88 per hour in the studio, €720 for an EP of up to 6 tracks (excl. VAT €152.89, €72.73, €595.04)
  • Podcast recording: €78 per hour, €295 per episode of up to 90 minutes raw (excl. VAT €64.46, €243.80)
  • Mastering: €98 per track, €430 for an EP of up to 6 tracks (excl. VAT €80.99, €355.37)
  • Rehearsal room: €48 per hour, €285 for 8 hours (excl. VAT €39.67, €235.54)

Time beyond the reserved block is charged only if you ask for it, per half hour started, at that service’s hourly rate. Extras appear on the invoice only if they are on the quote or if you later ask for them in writing. A separate note on mix cost sits in the mixing budget guide.

6. Deposit and payment

When you book you pay 30 % of the price including VAT. That sum is a deposit: a part-payment of the price, not a sum you may simply walk away from. We deduct it from the final invoice.

You can pay by bank transfer. In the studio we also accept a debit-card payment. Consumers pay the balance on the day of the session. For work we deliver at a distance (mix or master) the balance is due when we deliver the version you have approved.

Traders pay within 14 days of the invoice date. Late payment attracts the statutory commercial interest of article 6:119a of the Dutch Civil Code, plus extrajudicial collection costs under the Dutch decree on those costs, without a further demand once you are in default.

While the invoice is unpaid we may hold back the final files. Working sessions stay archived as article 11 describes.

7. Rescheduling and cancellation by you

Tell us about a move or a cancellation by e-mail or telephone and confirm it in writing. If you arrive late, the session is shortened by the same amount; we cannot run over if the next block is already taken. These rules do not cut down the consumer withdrawal right in article 8.

8. Right of withdrawal

If you conclude the contract as a consumer at a distance (by e-mail, telephone or the form) or off-premises, you have 14 days from the conclusion of the contract to withdraw, without giving reasons and with only the costs the statute names (article 6:230o of the Dutch Civil Code). That right does not apply to a contract you conclude at the studio itself.

If you want the session or the delivery to start during those 14 days, you must ask for that expressly. If you then withdraw, you pay a proportionate amount for what was supplied up to your statement. The right of withdrawal ends when the service has been fully performed before the period expires, and performance began after your express prior consent and your acknowledgement that you lose the right (article 6:230p, opening words and (a), of the Dutch Civil Code).

You withdraw with an unambiguous statement to [email protected] or by post to Danzigerkade 78, 1013 AP Amsterdam, the Netherlands. You may use the model below. We refund within 14 days of receiving your statement, by the same means of payment, unless you agree otherwise (article 6:230t of the Dutch Civil Code).

9. Cancellation or change by the studio

If we have to cancel a session — failed equipment, an engineer who is ill, an incident in the building — we tell you as soon as we can and offer a new date. If that date does not work, we refund everything you have already paid within 14 days. We do not swap in another engineer without telling you; that happens only with your agreement.

10. How sessions run

The studio is open Tuesday–Friday 10:00–20:00, Saturday 11:00–18:00. Closed Sunday and Monday. and by appointment only. There are 3 rooms, including a live room of 42 m² and 2 isolation booths. The live room holds at most 6 guests at once. The minimum age is 16. If you are under 18, a parent or guardian books and pays, and stays reachable or present during the session.

You treat the rooms and the kit with care and follow the engineer’s instructions. Smoking and vaping in the building are not allowed. We may stop a session if people’s safety or the equipment is at risk, for example because of dangerous behaviour; the reserved block then remains payable. Damage to studio equipment caused by your fault or neglect is for your account. Gear you bring stays in your care; your own insurance is wise.

Long, loud listening can damage hearing permanently. We work at a moderate level and plan breaks. Ask at any time for the volume to come down. Practical vocal preparation is in preparing a vocal session.

11. Files, delivery and archive

Unless the quote says otherwise, we deliver the agreed formats through a download link or on a drive you bring. Delivery times for mix and master run from the moment we have complete, usable files, and are counted in working days. Which format fits a podcast is discussed in podcast audio formats.

We keep a copy of the sessions for 24 months after the last session or the last delivery, and then delete it. It is your job to collect and store your files during that period. A longer hold is possible only if we agree it in writing.

12. Revisions

Mixing and Mastering each include 2 revision rounds, as the service pages describe. A round is one bundled list of notes that we handle in one pass. Extra rounds, or a new artistic direction after you have approved a version, go through a fresh quote.

13. Intellectual property

Your works. Compositions, lyrics and arrangements you have us fix remain yours or their authors’. You warrant that you hold the permissions you need for works, samples and covers, and you make the filings with collective management organisations. The studio claims no copyright in your works.

The fixation. The producer of a phonogram is the person who takes the initiative and the responsibility for the first fixation of a sequence of sounds. If you commission and pay for the recording, that status is yours. To the extent Claviforge B.V. could still claim neighbouring rights in the fixation made for you, it assigns them once the invoice is paid in full. A factual note, not advice, is in mastering and rights.

Performers. Fixing and exploiting a performance needs the performer’s authorisation. You obtain that from the musicians, singers and guests you bring.

Voice and AI. We do not use your recordings to train AI systems and we do not clone a voice without a separate written authorisation from the person concerned.

References. We do not name you or your project as a reference without your written consent.

14. Liability

The booking is a contract for services (overeenkomst van opdracht) within the meaning of article 7:400 of the Dutch Civil Code. We take the care of a reasonably competent contractor (article 7:401). The artistic result also depends on your preparation and choices; we cannot guarantee that result.

Our liability is limited to direct loss that was foreseeable when the contract was concluded, and only if the failure is attributable to us. That cap does not apply in cases of intent or wilful recklessness, not to personal injury, and not where mandatory consumer law requires otherwise. Towards traders, and outside intent or wilful recklessness, the total for one booking is limited to the price including VAT on the matching quote; consequential loss such as lost turnover is excluded.

15. Conformity

When we supply audio files to a consumer, those files must conform to the contract. Digital content is subject to the conformity rules that Book 7 of the Dutch Civil Code attaches to such supplies (implementation of Directive (EU) 2019/770). If a delivered file is defective or differs from the quote (format, duration, version), tell us; we repair it or deliver again, at no extra charge.

16. Force majeure

Neither party is liable for a failure caused by force majeure, article 6:75 of the Dutch Civil Code. The party that is prevented tells the other as soon as it can. The session is moved to a date chosen together. If the obstacle lasts more than 28 days, or no new date works, either party may end the contract and we refund sums paid for services not performed.

17. Personal data

We process your data under the privacy policy. The contact form is delivered by FormSubmit, a United States service; the transfer to the United States relies on the EU–US Data Privacy Framework or on standard contractual clauses, with the safeguards the privacy policy names. If you are a trader and you send us data about other people (guests, musicians), the data processing agreement applies.

18. Complaints

Send a complaint in writing to [email protected] or to Danzigerkade 78, 1013 AP Amsterdam. We reply within 2 days. Claviforge B.V. is not affiliated with a recognised dispute committee; we do not invent a mediator. If the dispute stays open, you may go to the competent court, as article 19 sets out. The Netherlands Authority for Consumers and Markets supervises consumer rules; that is not dispute resolution for your particular booking.

19. Governing law and forum

Dutch law governs these terms and the contract. A consumer may, among other venues, choose the court of his or her domicile or the District Court of Amsterdam, and keeps the jurisdiction that the Dutch Code of Civil Procedure and EU law (including the Brussels I bis Regulation) confer.

Claviforge B.V. brings disputes with traders before the District Court of Amsterdam, unless mandatory law points to another court.

20. Final provisions

If a clause is void or is avoided, the remaining clauses stay. A valid rule that comes as close as possible to the original intent then applies instead. Not relying on a clause is not a waiver. We may change these terms; the version that applied on the day you accepted the quote remains the one for that booking. If language versions differ, the Dutch text prevails. This version applies from 1 October 2026.
